Terms and Conditions – Sound Checks

These Terms and Conditions govern the hire of equipment and related services provided by Sound Checks. By placing a booking with Sound Checks, you agree to be bound by these Terms and Conditions.
1. Definitions
"Company" refers to Sound Checks.
"Customer" refers to the individual, organisation, or business hiring equipment from Sound Checks.
"Equipment" refers to all items supplied by Sound Checks, including but not limited to sound systems, speakers, microphones, lighting, staging accessories, cables, and related equipment.
"Hire Period" refers to the period agreed between Sound Checks and the Customer for the use of the Equipment.
2. Bookings
2.1 All bookings are subject to availability.
2.2 A booking is not confirmed until Sound Checks has issued written confirmation.
2.3 Sound Checks reserves the right to refuse any booking at its discretion.
2.4 The Customer is responsible for ensuring all booking details are accurate.
3. Payment
3.1 Payment terms will be specified on the quotation or invoice.
3.2 Sound Checks may require a deposit before confirming a booking.
3.3 Full payment must be received before delivery unless otherwise agreed in writing.
3.4 Late payments may be subject to additional charges and interest where permitted by law.
4. Delivery and Collection
4.1 All Equipment is delivered and collected by Sound Checks' internal delivery team.
4.2 Delivery and collection times are estimates and may be affected by circumstances beyond our control.
4.3 The Customer must provide safe and reasonable access to the delivery location.
4.4 Additional charges may apply where delivery or collection is delayed due to circumstances within the Customer's control.
5. Equipment Use
5.1 The Equipment remains the property of Sound Checks at all times.
5.2 The Customer shall:

Use the Equipment only for its intended purpose.

Operate the Equipment safely and competently.

Follow any instructions provided by Sound Checks.

Keep the Equipment secure and protected from theft, loss, damage, weather, and misuse.
5.3 Equipment must not be modified, altered, repaired, or tampered with without prior written consent from Sound Checks.
5.4 The Equipment must not be sub-hired, loaned, or transferred to any third party.
6. Responsibility for Equipment
6.1 Responsibility for the Equipment passes to the Customer upon delivery and remains with the Customer until collection by Sound Checks.
6.2 The Customer is responsible for any loss, theft, damage, or destruction occurring during the Hire Period, regardless of cause.
6.3 The Customer shall immediately notify Sound Checks of any damage, malfunction, loss, or theft.
6.4 The Customer may be charged for repair, replacement, cleaning, or recovery costs where required.
7. Inspection and Acceptance
7.1 The Customer is responsible for inspecting the Equipment upon delivery.
7.2 Any issues or shortages must be reported as soon as reasonably possible.
7.3 Continued use of the Equipment constitutes acceptance that it was delivered in satisfactory condition.
8. Breakdown and Technical Issues
8.1 If Equipment develops a fault during the Hire Period, the Customer must contact Sound Checks immediately.
8.2 Sound Checks will make reasonable efforts to repair or replace faulty Equipment where practical.
8.3 Sound Checks shall not be liable for losses arising from equipment failure beyond the hire charges paid for the affected Equipment.
9. Cancellation
9.1 Cancellation requests must be made in writing.
9.2 Unless otherwise agreed:

More than 30 days before the event: Deposit refundable, less any administration costs.

14–30 days before the event: 50% of the booking value may be payable.

Less than 14 days before the event: Up to 100% of the booking value may be payable.
9.3 Sound Checks reserves the right to retain deposits to cover costs already incurred.
10. Force Majeure
Sound Checks shall not be liable for failure or delay in performing its obligations where such failure results from circumstances beyond its reasonable control, including but not limited to:

Severe weather

Floods
-
Fire
-
Industrial disputes
-
Road closures
-
Government restrictions
-
Acts of God
11. Limitation of Liability
11.1 Nothing in these Terms excludes liability where it cannot legally be excluded.
11.2 Subject to applicable law, Sound Checks shall not be liable for:

Loss of profits
-
Loss of revenue
-
Loss of business opportunities
-
Indirect or consequential losses
-
Event cancellation costs
-
Reputational damage
11.3 The total liability of Sound Checks shall not exceed the total hire charges paid by the Customer for the affected booking.
12. Health and Safety
12.1 The Customer shall ensure Equipment is used in a safe environment.
12.2 Equipment must not be operated by anyone who is intoxicated, unqualified, or otherwise incapable of using it safely.
12.3 The Customer is responsible for complying with all applicable health and safety regulations during the Hire Period.
13. Insurance
13.1 Sound Checks recommends that Customers obtain appropriate insurance coverage for hired Equipment.
13.2 Customers may be required to provide proof of insurance for high-value hires.
14. Data Protection
14.1 Sound Checks will process personal information in accordance with its Privacy Statement and applicable data protection laws.
14.2 Customer information will only be used for legitimate business purposes, including booking administration and service delivery.
15. Termination
Sound Checks reserves the right to terminate a hire agreement and recover Equipment immediately where:

The Customer breaches these Terms and Conditions.

Equipment is being misused.

Payment obligations are not met.
-
Continued hire would pose a safety risk.
16. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
